    Will there be Jewish run banks in Eretz Yisroel after Moshiach comes? If so, how will they function? Would they be allowed to charge interest?

    I guess I always assumed that bizman Mashiach, at least for the tzibbur as a whole, we wouldn’t be relying on kulos or heterim. I assumed Klal Yisroel as a whole would be on a high enough madreigah to follow the din as intended and not have to rely on heterim like heter iskah or prozbul (for example).

    so then what were you asking?

    Do you think Hashem made heter iskah and pruzbel muttar by mistake ch’v? It’s for ordinary loans that the original halachos are for- like if you borrow $100 for a week. Noone does a heter iska for that…

    Hashem didn’t “make” them. they are takanos d’rabanon”

    It’s for ordinary loans that the original halachos are for- like if you borrow $100 for a week. Noone does a heter iska for that…

    Both Heter Iska and Pruzbul are takanos that the Rabanan made, using processes that were Mid’oraisa acceptable. The Rabbanan just codified the procedures for those not well enough versed in all the sugyos.

    Midwesterner: That would be a great assumption, however the Gemara (Gittin 36b) says Mefurash otherwise. Pruzbul won’t work in Yemos Hamashiach because it only works for Sh’mittah D’rabannan, not Sh’mittah D’oraisa. Why it doesn’t work Min Hatorah is incredibly unclear, but apparently it doesn’t.

    Who puts money in banks? People are turning towards investment companies, which are real, live Iskos.

    Not everyone held of the Heter Iska. The Shla Hakadosh was famously against it. He said Hashem knows what you are doing, even after the fancy trick.

    It seems to boil down to a Machlokes if Ribis is a moral issue, in which we care about the ‘spirit of the law’, or if it is merely a Chok that once circumvented is not being transgressed. By an Assei you can be Mehader and look to be Mekayem, as in putting on a four-cornered garment to require Tzitzis, but when there is no Lav there is nothing to be Mehader about (unless it has a Rei’ach Aveira).

    You are confusing Prozbul with Heter Mechirah, which does rely on the fact that Shmittah is D’Rabbanan in our times according to most opinions. When Prozbul was created, we were still observing Shmittah D’Oraita as the Temple was still standing; it will therefore continue to work when the Third Temple is in operation.

    One of my Rebbeim used to question the common practice of having long peyos based on that logic. He would say there is no such thing as a hiddur by a lav.

    Charliehall: Wrong. The Gemara is Mefurash like me (though one De’ah in Tosfos has a possibility otherwise, but we don’t Pasken like the opinion that he is going like anyway). Pruzbul only works in Sh’mittah D’rabannan. Look it up there (Gittin 36b).

    Charliehall, he is not confusing anything. Check out the Gemara Sam referenced. Shmita was a Derabanan during Bayis Sheini as well, according to that Gemara. Heter Mechira as a concept is not in the Gemara.
