If a jewish doctor is asked to carry out a death sentence by lethal injenction to a none jew. May he comply? Or is he considered a murderer? Do we say dena dmalchusah denah and he may comply or not?
November 11, 2009 3:45 pm at 3:45 pm #668876WolfishMusingsParticipantFrom what I understand, most doctors will NOT participate in executions. It’s usually medical techs who do the work. The doctor merely pronounces the person dead when the procedure is done.

November 11, 2009 3:53 pm at 3:53 pm #668878Just-a-guyMemberWhy would it be considered murder?
November 11, 2009 4:10 pm at 4:10 pm #668880John DoeMemberkeep the bubba mayses coming.
they are great!
November 11, 2009 7:04 pm at 7:04 pm #668883haifagirlParticipantConsidered murder by whom? Certainly not by the government. But wait . . .
One person kills another person. Yep. Sounds like murder to me. Government-sanctioned murder.
November 11, 2009 7:12 pm at 7:12 pm #668884ronrsrMemberif an Israeli soldier kills a terrorist loaded with explosives on the streets of Tel Aviv, is that 1) not murder 2) murder 3) self-defense 4) government-sanctioned murder?
November 11, 2009 7:13 pm at 7:13 pm #668885haifagirlParticipantDefinitely defense of the city. Not murder.
November 11, 2009 8:33 pm at 8:33 pm #668886mybatMemberRonsr that’s not murder its a mitzvah!
November 11, 2009 9:42 pm at 9:42 pm #668887ronrsrMemberonly because of governmental laws. Take the same act, place it in Damascus, and the Israeli soldier would likely be tried and executed for murder. Same act, same principals.
November 11, 2009 10:07 pm at 10:07 pm #668888JotharMemberThen the question is, can one work as a medical tech to do the lethal injection? Gentiles are obligated to keep their laws, and one who commits murder has violated one of the 7 commandments of the gentiles and is muchuyav in death.
November 11, 2009 10:43 pm at 10:43 pm #668889ronrsrMemberI don’t believe that in the USA anyone is FORCED to do that as part of a job. They generally ask for volunteers.
November 15, 2009 2:04 am at 2:04 am #668890HaLeiViParticipantThere days they don’t kill for anything other than murder, I think/hope. Therefore, the man is actually Mechuyav Misa.
November 17, 2009 5:07 am at 5:07 am #668891d aMemberHow about a doc/tech/nurse/ect./whatever… pulling the plug on a patient?
November 19, 2009 9:06 am at 9:06 am #668892williMemberronser – A.abt the soldier in Israel example. haba lehurgecha hashkeim lehorgoi
B. interesting point. Who would ever want to be the volunteer?
Just curious, would any of the posters here agree to be the volunteer of killing murderer (declared by court? What about Saddam Hussein? Hitler? Is there a difference bet. a mass murderer or someone who killed “only 1” human being?
Da- In my opinion, a sympathetic moral person would rather NOT pull the plug on a patient, al pi torah definitely assur. though others might disagree since it’s a controversial topic…
November 19, 2009 2:07 pm at 2:07 pm #668893mazcaMemberif this is the case people do not have any idea what a transplant is. For a person to receive a liver, kidney or other type of transplant the person is kept alive until ready to transplant at the moment the plugs are turn off and then remove the necessary organs so do people kill people for their organs? The organs do not come from a death person they come from a death brain person whatever that means. So does anybody receiving any type of transplant considered a murdered . Are people really aware?
November 19, 2009 2:29 pm at 2:29 pm #668894haifagirlParticipantmazca: That is certainly true for heart donors and lung doners, but livers and kidneys are taken from live donors who remain alive.
November 19, 2009 2:42 pm at 2:42 pm #668895anon for thisParticipanthaifagirl, live donor liver transplants (actually part of the liver) are relatively new, and are only done at certain medical centers. These constitute about one-third of liver transplants in the US. Most recipients are children.
November 20, 2009 7:14 am at 7:14 am #668896mazcaMemberhaifagirl. a person can get a liver transplant from a live donor or “death Donor” my brother in law makes kidneys and livers transplants and he is the one that made me aware that people are really alive when they donate their organs. He says most people are not even aware or do not want to be aware that a person dies in order for them to live.
November 26, 2009 8:43 am at 8:43 am #668897HaLeiViParticipantWilli,
There must be a difference between a simple murderer and a mass murderer. One is a Rasha, and the other is a Rasha Merusha.
Actually, the Zohar Hakadosh asks how come it says Baavod Resho’im Rina, while we also know about the Chazal of Maase Yodai Tvuim Bayam Veatem Omrim Shira. It answers that there is a difference between someone who did bad and someone who is thoroughly evil. On someone who is completely evil, there is happiness when he’s punished. Otherwise, we always have some Rachmanus.
November 29, 2009 6:28 am at 6:28 am #668898charliehallParticipantI’ve had two different rabbis tell me that it is not permitted for a Jew to serve on a jury on a capital case in the United States because the standards for administering a death penalty fall far below what the Torah requires even for Noachide courts. I would presume that a prohibition of a doctor participating would be a kal v’chomer.

I’ve heard that as well.

I am not a doctor and not much of a carpenter either for that matter, but I would volunteer in one second flat to dispatch Nidal Hasan Malik yms or Khalid Sheikh Mohammed yms with a blunt bladed circular saw. Ditto for the Mumbai terrorist whose name I conveniently forget.
I would have done the same for self proclaimed penitent Tookie Williams, for Ted Bundy, and most of all for Ted McVeigh, whose dispatch I celebrated with a bottle of champagne while listening to “Another One Bites the Dust” at the moment he began his descent to sheoil tachtis.
However, I am sure that there are other cases which are not as clear.
