High Court Rejects Petition to Stop Shas-Affiliated Sukkos Event


sukkah.jpgThe High Court of Justice on Tuesday, first day Chol Hamoed Sukkos, rejected a petition filed by attorney Yossi Chavilov, seeking to block an el HaMayan ‘Kabolas Pnei Rabbo’ Sukkos event set for Wednesday, at Sultan’s Pool in Yerushalayim. The court is willing to hear the case, but not before it takes place on Wednesday, the second day Chol Hamoed Sukkos in Israel.

The petition to block the event was first filed with a Jerusalem Administrative Court, claiming Jerusalem City Hall participating in funding the event is not legal. The court set a date for the case after Sukkos, leading to the petition, seeking an injunction to stop the event.

Justice Yitzchak Amit rejected the petition, explaining that due to the pressing time since the event is scheduled for the following day, he does not feel a hearing on the matter should be held before the event. The court was also unwilling to issue a temporary injunction blocking the event.

The court did stipulate that if the event is held, it is entirely possible that el HaMayan will have to reimburse the city in the amount allocated by the municipality for the event as well as paying court costs for the petitioner.

As such the event will be held in the presence of HaGaon HaRav Shalom Cohen Shlita. Entertainers will include Yaakov Shwekey, Chaim Yisrael and Shlomo Cohen.
