The Mehersha ecplains why whether it is easier to have been born or not. There are 365 negative mitzvos, so doing noting and not be born accomplishes more than 248 positive mitzvos by having to do something and be born.
That is why they counted in Eurevin to determine what is more worthwhile, to be born or not.

Why do we say ולא כאשר עשה only sometimes if the chumash doesnt restrict it?

The Ramban explains that the Beis Din would not have judged one to die if not being respnsible. The Dubner Maggid says that the first died innocently but the second was responsible. So it is not midah kaneged midah.

The gemora says that how great are the chachomim that they only gave thirty nine lashes even though it says forty. The greatness of the chachamim was that they did everything possible by recognizing pain to eliminate even one.
It says that the people of bavel are fools as they stand up infront of the Torah but not the learners which is specified in the pasuk. Standing up infront of the Totah is a kal vechomer.
Explains the Baal Akedah that we still give special honor to the source as dayah lavo, we cannot learn more from the kal vechomer than the source.

Why are eidei hsckchasha different than eideo haazams? By eidie hackchasha the argument is destroyed but not the eidim whereas by the eidei haazama the eidim’s trustworthiness is destroyed, so they are not credible anymore anywhere.

I made a siyum on Maakos a few months ago. I didn’t say a lomdish vort, I went more with just a thought that had occurred to me.
If you look at the sugyos that deal with punishments that are bein adam l’makom, you can see just how much Hashem loves us. He made the rules so that it’s always easy to reduce punishments, and the “full” punishment seems to be rarely given.
Additionally, after going through a masechta that deals with punishments, just in case someone would think that Judaism is all about punishing us, it ends with a message of hope, and the promise of our redemption.
See how much Hashem loves us!

The Sefer Hachinuch 365 says how great the Torah is that took away the suspicion for the rest of her life of being a sotah once she drank the water.

Interesting Question, Reb Eliezer: Can a woman be a Sotah more than once? Supposing that, say, 5 years after drinks and is found innocent, a similar situation arises that caused her to undergo the ordeal in the first place?

Assuming the vort is for a sheva berachos or related event Try this Actually, you could massage this to fit other situations.
    Re: Bayas Ne’eman

A word about emunah. As alluded to in the above cited pasuk in Beshalach, Emunah is not simple blind faith. Emunah requires an objective reason, in seeing and recognizing the Yad Hashem. You are familiar with the following gemorah in Maakos:
Rabban Gamliel, R’Elazar ben Azaria, R’Yehoshua and R’Akiva went up to Yerushalaim. When they reached Har HaBayis they tore their garments when they saw the Churban and, as they were viewing the wreckage, they saw a fox run out of the ruins of the Kodesh Kodoshim. All of the Tannaim except Rabbi Akivah, began to cry but Rabbi Akiva began to laugh. Rabbi Yehoshua asked, “Akiva, why are you laughing?” (He could address R’Akivah without the honorific because he was R’Akivah’s rebbi.). R’Akiva replied, “Well, why are you crying?” R’Yehoshua replied,” The holiest place in the world, a place where no stranger may enter except the Kohen Gadol and that only once a year is now a home for animals! Should we not cry?” R’Akiva explained. “There are two nevuahs. The first, by Uriah (actually Michah, see Rashi, loc cit) predicted the destruction of the Beis HaMiqdash in detail, including the prediction that it would become a home for animals. The second, by Zechariah, predicts the rebuilding. Now that I see the first nevuah is literally correct, I am confident that the second will be fulfilled.” Note that R’ Akiva’s belief in the Geulah and the restoration of the Beis HaMiqdash wasn’t simply a hope. It was based on his observation of the explicit kiyum of known nevuah.
So that’s the key. As we experience and witness the reality around us, may the Riboneh shel Olam grant us the eyes to see and the intellect to recognize His Hand in the world, and may He also allow us to witness, with our own eyes, the complete Geulah and Biyas Moshiach, b’meheirah b’yameinu.
