In response to the thousands of pashkevilin that were dumped in the streets of Boro Park, Councilman Greenfield is preparing a legislative solution. “No one has the right to throw thousands of pieces of paper on our streets. It damages our community, litters our streets, causes our sewers to back up and causes innocent people to be fined.”
“We need to send a clear message that there will be serious consequences of jail time and a significant fine for the people who do this. There needs to be serious ramifications for this kind of vandalism.”
Upon completion, the Law Committee of Community Board 12 will review the proposed legislation. “You don’t channel your anger by defacing our community,” said Aaron Tyk, Vice Chairman of the Committee. “Such conduct not only is a blatant desecration of Toras Hashem, it also is a gross violation of the social contract pursuant to which we conduct ourselves”.

What is there to “review”? Anyone dumping garbage in the streets is violating the law and should be prosecuted. Why is there even a shaiylah? There is no First Amendment right to vandalize public property and impose thousands of dollars in additional costs for cleanup on public and private property owners.
Go David go, two years ago in Williamsburg NYPD and sanitation PD were watching all night to catch one of these goons, well they did and its was 2 guys in a car service, PD took the car and the two guys were given violations.
This pashkevillin came from Israel years ago, thats how the Jewish talibans settle a divorce, vusiness dispute, chassides, eriv, etc;
They first started forging signatures of Rabbis on every kol korah, when that failed they started with anonymous pashkevilin, because they have no B—-s or guts to sign thier name.
Once caught, arrest them, thier name, address and all phone #s should be released to the public and if he is a bucher then his parents name should be released, and all information to be thrown all over the street-lets see what will happen then.

BTW David, Sanitation PD and enforcement is to blame as well, they have been watching this for years in Williamsburg and Boro Park and did squad-nada-ziltsh-gurnisht.

I don’t know what role, under the City Charter, a Community Board has in reviewing proposed legislation. There is already a statute against “dumping” and one against “littering” that sshould cover this offensive offense. And the halacha on Chillul Hashem is clear.
The Councilmember and the Community Board should instread look into solving the traffic nightmare in Boro Park, and the resulting air pollution that is poisoning our children. Perhaps narrower electric school buses could be investigated, or consolidating one buses stops to 2 on a block.
You can’t do more than give a civil violation notice that is merely a nominal financial fine. This is because you cannot Constitutionally target this kind of littering based on the speech it contains. The legislation must be broad based and include any and all kind of literature that is littered in the streets.
Which means if you make too strict a penalty, the next time some business in Queens or Staten Island make the mistake of littering their advertising, they might face a 18 month jail sentence.
If someone is dumping pieces of paper on the sidewalk or on the street, that is littering, an dis already illegal. However placing pieces of paper discussing matters protected by the First Amendment in places where one can legally do so is a constitutional right.

Btw, it is also illegal to put those big posters on street lamp poles.
