Lawyers want a full appeals court to reconsider a three-judge panel’s decision to remove a judge from New York City’s stop-and-frisk litigation.
The lawyers who originally sued the city filed papers Monday with the 2nd U.S. Circuit Court of Appeals in Manhattan.
They say the three federal appeals court judges were wrong to remove U.S. District Judge Shira Scheindlin from the case last month.
She found that stop-and-frisk discriminated against minorities and ordered changes to the practice. The three-judge panel removed her, calling her impartiality into question. The city has asked the appeals court to throw out her decision.
The lawyers say in the latest court papers that the entire 2nd Circuit should reconsider the three-judge panel’s order. They call it unprecedented and procedurally defective.
