A 90-year-old woman who got onto a Kavim Company bus and then fell as a result of the driver pulling out of the station before she could be seated, will be compensated. As a result of the fall, the woman sustained factures and bruises. She was taken from the scene in an ambulance, transported to Ichilov Hospital, where her condition continued to deteriorate, and she has since become reliant on nursing care.
The family of the woman turned to attorney Adir Schweigman, who filed a lawsuit against the Ayalon Company, which insures the bus company with its liability policy. The two sides reached a compromise and the woman will be compensated in the amount NIS 440,000.
According to Adv. Schweigman, an injury caused during a bus ride, or as a result of getting on or off the bus, is considered a road accident and may be compensated under the Road Accident Victims Compensation Law, regardless of whether the bus itself was involved in an accident or not.
“Many in the public do not know this, and in effect give up compensation that can sometimes reach hundreds of thousands of shekels,” says attorney Schweigman.
