Court Rules Barkan Terrorist Will Remain In Jail Until May


The IDF Military Court of Appeals accepted the State Attorney’s appeal regarding if the Barkan terrorist will remain in jail.

The Vice-President of the Military Court of Appeals, Colonel Tzvi Lekach, accepted the State Attorney’s Office’s appeal and ruled the terrorist from Barkan will remain in incarceration until May. Regarding the argument for his release, the court added, “As far as the point is concerned, the period of his detention until now is close to the punishment he is expected to receive. Not only am I not a partner to it, but it stands in contradiction to my explicit statement that ‘the expected punishment for them (the terrorist and his brother) is not going to be at all easy.

He added that “at this stage it is impossible to ignore the fear of escape from the fear of justice.”

Last week, a judge of the military court decided to release the mother of the terrorist from Barkan terrorist attack to house arrest, because “it is difficult to expect a parent to turnover his son.” The Military Prosecution appealed the decision, and as stated, the Military Court of Appeals accepted the appeal.

Attorney Chaim Bleicher of Honenu, representing the families of the murdered victims; Kim Levengrond Yechezkel HY”D and Ziv Hajbi HY”D said, “We welcome the court’s decision. There is a clear statement by a high court that the punishment of someone who does not prevent terrorist murder must be significant, and perhaps especially to the terrorist’s family.”

On October 7, 2018, a Palestinian terrorist from a village near Tulkarem, opened fire on workers in a second floor office in the Barkan Industrial Park in Shomron. The two victims mentioned above were killed after being bound to a chair.
