Israel’s High Court of Justice on Monday, 26 Tammuz, heard a petition filed by the family of IDF Lt. Hadar Goldin HY”D, whose remains are in the hands of Hamas in Gaza. The petition called on the court to order the state not to return the bodies of terrorists until their son’s body is returned by Hamas.
Justices Noam Hendel, Uri Shoham and Yosef Elron ruled the decision to return bodies is that of the cabinet and the court will not involve itself in that decision.
On Sunday, the government submitted confidential material to the court regarding the three terrorists, two of whom were shot to death during attempted attacks and the third during the procedure for apprehending a suspect. The Goldin family argued that, given that the information is confidential, they have no ability to criticize the state’s decision to return the bodies, and therefore they asked the court to examine the confidential material, albeit ex parte.
