A lawsuit was filed on Wednesday 1 Cheshvan 5773 in the Lod District Court on behalf of Rachel Atias, the lone survivor of her family, killed in a vehicular crash near Tiveria.
According to a Yediot Achronot report, attorney David Ohr-Chen is representing Rachel, filing a lawsuit against the ‘שומרה’ insurance company in the amount of 13 million NIS.
Since the fatal accident, Rachel moved in with her aunt in Tzfas. Her attorney explains “she will suffer her entire life” as a result of the accident, hence the lawsuit, which he explains will finance her ongoing therapy and permit her to hopefully one day have a normal life.
Killed in the crash in Tiveria were Rabbi Rafael Atias, 42, principal of a Tzfat yeshiva, his wife Yehudit, 42, Avia (female-17), a student in a Meron ulpana (high school), twins Elyashiv and Neria Shimon (16), Shira (11), Ta’ir (girl-8) and Noah (girl – 4).

If people are allowed to file such claims, it will result in auto insurance becoming prohibitively expensive.
Of course, providing a livlihood for lawyers can’t be all bad. Would you want them to change careers and become mobsters or drug dealers or corrupters of the banking system?
On what grounds is she suing the insurance company? Isn’t she covered only up to the limits of her policy??
The accident was a tragedy.
The sorry facts are, there were no brakes, they were gone, it was metal on metal.
When the brakes get to that state, there are tell tale signs for weeks that your brakes are going.
I am not sure why Rabbi Attias was not aware of them or ignored them. Some people have an its alright attitude, or just dont want to spend money to have something fixed or looked at.
I see nothing halachic in such a lawsuit. Probably a lawyer wanting to make a buck. Bad doesnt fix bad. I wish Rachel all the best.
