Former State Senate Majority Leader Bruno Indicted A Second Time

Former state Senate Majority Leader Joseph L. Bruno has been re-indicted by a federal grand jury and is scheduled to appear in federal court Thursday afternoon.

The federal grand jury recently completed its review of kickback allegations involving Bruno, whose first conviction on similar charges was vacated by a federal appeals court last November.

At the time, Justice Department officials had said they would seek a new indictment of Bruno after the U.S. 2nd Circuit Court of Appeals overturned his conviction on two counts of honest services fraud. Federal prosecutors conceded Bruno’s first conviction could not stand after the U.S. Supreme Court said a crime of honest services fraud must include a bribe or kickback, not just a failure to disclose a conflict of interest.

The new indictment against Bruno, 83, is scheduled to be unveiled at 2 p.m. before U.S. Magistrate David R. Homer. The Times Union reported two weeks ago that a new indictment against Bruno was imminent.

  1. So having subjected him to the distress and expense of a trial on a clearly bogus charge (did they really need the Supreme Court to tell them that what they charged him with is not a crime?) they’re going after him again; this is just revenge for having had their noses rubbed in their dreck.
