Federal Appeals Court Sides with Jewish School over Zoning Board


court hammer1.jpgA federal appeals court has upheld the controversial Religious Land Use Act, agreeing that the Village of Mamaroneck’s zoning laws cannot be used to block a Jewish school’s new 44,000-square-foot building (original story HERE on YW).

The 2nd U.S. Circuit Court of Appeals agrees with a lower court judge, William Conner in White Plains. Conner said Mamaroneck must issue a permit so the Westchester Day School can proceed with an expansion plan that had been turned down by the village.

The 400-student school had challenged the zoning decision in a lawsuit.

Lawyers in the case have said it’s likely to reach the Supreme Court.

  1. Why don’t I see all the “smart” “BNAI TORAH” saying: “Why do you have to tease the Goyim? just stick to yourself and learn Torah” like they side every time with the antisemits when its with Chabad?
