Hanicha where Tosafos says that the Gemara asked ????? ???? ???? ??? ??? in accordance with the Gemara in Bava Kamma’s original presumption (which it rejects) that there is a man d’amar who doesn’t hold of Dayo. But that does not show that there actually is such a man d’amar.
